EXECUTIVE ORDER COVID-19 

PROVlDING FOR A CURFEW FOR THE CITIZENS OF OSCEOLA COUNTY, FLORIDA; PROVIDING FOR ENFORCEMENT; PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, on March 16. 2020, a State of Local Emergency - Resolution #20-054R was declared under the
provisions of the Florida Statutes and the Osceola County Code due to the serious threat to life and property within the County arising from COVID-19; and 

WHEREAS, s. 252.38(3)(a)(5), Fl a Stat., gives the Osceola County Board of County Commissioners the power and authority, incident to a declared State of Emergency, to waive the procedures and formalities otherwise required of the political subdivision by law pertaining to taking whatever prudent action is necessary to ensure the health, safety, and welfare of the community; and 

WHEREAS, pursuant to Resolution #20-054R and Section 2-78 of the Osceola County Code of Ordinances, during a state of local emergency the Executive P licy Group shall have the power and authority, to impose by executive order, any restrictions outlined in F.S. s. 252.38, that are consistent with the comprehensive emergency management plan; and 

WHEREAS, the Executive Policy Group hereby finds that a curfew is a prudent action imperative to ensuring the health, safety, and welfare of the community. 

NOW, THEREFORE, the Executive Policy Group does hereby impose the following temporary emergency restriction, effective immediately, by the terms of this Executive Order: 

Section 1. A curfew is hereby established for all of Osceola County beginning at 11 :00 p.m. on March 20, 2020 until further notice and unless otherwise modified. All pedestrian and vehicular movement, standing and parking, except for the provision of fire, police. emergency and hospital services, public health, tow operators. medical patients, utility emergency repairs, state and local government employees providing emergency services, emergency calls by physicians, employees of businesses providing essential commodities and services e.g. food, water.
accommodations, petroleum and utilities within the above curfew areas, and travel related to work are prohibited during curfew hours. 

CURFEW HOURS SHALL BE FROM 11 pm TO 5 am. 

Section 2 . Any variance or exception to the prohibitions and/or restrictions set forth in Section I shall be valid only when stated in writing signed by the Executive Policy Group for the duration of the State of Local Emergency. 

Section 3. Any violation of this Executive Order is hereby enforceable by citation or any other means in accordance with the law, including arrest. The Kissimmee Police Department. the Osceola County Sheriff and the Saint Cloud Police Department shall have full powers to enforce this resolution within their respective jurisdictions.
