Vice Chairman Beigel made a motion to accept the minutes.
Mr. Krotts seconded the motion.
All Ayes 5-0 to approve the minutes.
The minutes were approved 5-0.
1. Request for Variance
(a) CASE NUMBER: 2009-02
APPLICANT: Sherry Cain
PETITION DETAILS: Applicant
is requesting a variance from the 20-foot rear yard setback requirement of the
Canoe Creek Estates Planned Unit Development (Ordinance # 2005-39) to allow an
encroachment into the rear yard resulting in a setback of 11 feet.
Mr. Morgeson informed the Board
that Mr. Paulsen would be a voting member at this meeting.
Dale Cozeck presented the case (see Staff Report).

Morgeson noted May 4th Memorandum, pages 1; 2; 3, all criteria have
to be answered in the affirmative to proceed with the variance.
Christopher Kulick, representative for U.S. Aluminums Corporation introduced
himself to the board.
Sherry Cain introduced herself to the Board.

Morgeson advised the Board to consider the 6-criteria.
Morgeson noted, the Board should expressly state the 6-criteria have been
considered, per the LDC.
Beigel made a motion that the 6-criteria have been met and the variance be
granted with the condition that the structure will be an enclosed screen room
with a permanent roof.
Paulsen seconded the motion to approve the variance with the conditions.
Ayes to approve the variance with the condition that the structure be an
enclosed screen room with a permanent room.
Nay to deny the variance request.
Krotts made a motion to adjourn the meeting.
Paulsen seconded the motion.
Ayes 5-0 to adjourn the meeting.
