DEVELOPMENT REVIEW COMMITTEE MINUTES

 

DATE OF MEETING:      October 2, 2003

NEW BUSINESS:

 

1.         Case #3-121.01 – Southern Pines (f/k/a Jowers PUD)

                                                Michigan Avenue, E. of Indian Lakes Subdivision

                                                Final Plat

 

Mr. George Jalovecky was present to represent the application.

 

BUILDING DEPARTMENT

INFORMATION:

1.         This case has no effect on the building department.

 

PUBLIC WORKS

CONDITIONS:

1.                   We recommend the dedications portion of the plat include references to the tracts which shall be dedicated to the HOA.  Currently the tracts to be owned or maintained by the HOA are included only under the surveyor notes.

 

Mr. Jalovecky noted that he had discussed this matter with Maronda Homes’ attorney and had been advised that such dedications could not be done on the plat.  He explained that they indicated it was usually shown only as a note with separate deeds assigned to the HOA for those parcels.

 

Mr. Nearing explained that it had always been done this way and that the City’s Attorney would need to be consulted to see how the issue needed to be addressed.

 

Mr. Luthie noted that some kind of a decision needed to be made for policy reasons so the staff would know how to address the same issue on future projects.

 

Mr. Jalovecky noted that he would provide staff with a copy of the letter from the attorney.

 

Mr. Nearing advised Mr. Jalovecky to give a copy of the letter to Mr. Groenendaal and he would make sure the City’s Attorney got it.

 

2.         The 10-foot utility easement abutting Brown Bear Ct. will need to encroach onto the City of St. Cloud property in order to maintain the 10-foot width.  We may need to obtain the additional easement from the City of St. Cloud for purposes of the electric utility. 

 

Mr. Jalovecky noted that he had discussed this issue with OUC and it had been determined that the additional easement was not needed.  He explained that there was an existing old SLIC right-of-way that could be used if necessary but he felt there was going to be adequate room for everything in the current easement provided.

 

Mr. Nearing advised Mr. Jalovecky to coordinate the easement issue with Angelo Perri and Mark Luthie.

Mr. Luthie explained that if additional room is needed, the City need only grant permission to utilize the existing SLIC right-of-way.

 

Mr. Jalovecky again noted that he didn’t think it was going to be an issue because there was plenty of room.

 

LINES DIVISION

INFORMATION:

1.         No comment.

 

FIRE DEPARTMENT

INFORMATION:

1.         Approval of this case will not cause an adverse affect on fire rescue department operations.

 

OUC (ELECTRIC UTILITY)

CONDITIONS:

1.         Please contact Jeff Mann, OUC Engineer for the project to see if the easements meet the needs for the electric.  Phone (407) 384-4013, cell (321) 436-6271, fax (407) 384-4126, email jmann@ouc.com.

 

Mr. Jalovecky again noted that he had discussed this issue with Mr. Mann and agreed to provide anything that was needed but didn’t think it would be.

 

PLANNING

CONDITIONS:

1.                   Surveyors notes on the boundary survey start on #9 is there 1-8.

2.                   Note 6 on the plat dedicates maintenance to Michigan Avenue Associates LLC may be it should be dedicated to the owner or developer.

 

Mr. Jalovecky noted that Michigan Avenue Associates, LLC were the owners and developers of the property and that this would be addressed at the time of future development.

 

3.                   Change the City Council approval box from City Manager to City Clerk. The City Clerk is Lori L. McCorkle.

 

Mr. Jalovecky noted that he would make the necessary changes.

 

4.                   Change the Planning Board approval box to read Planning Board not Planning Advisory Board.

 

Mr. Jalovecky noted that he would make the correction.

 

5.                   Need new surveyors letter that certifies that the minimum width and minimum area as outlined in the PUD documents including the corner lots and potential new corner lots.

 

Mr. Jalovecky noted that he would provide the letter as soon as it was ready.

 

INFORMATION:

6.                   Revised plans must be submitted within sixty (60) days of this review.  Revised plans submitted after the allotted time frame will require a new application including payment of additional fees.

7.                   All submitted plans must be folded at the time of submittal.  Rolled plans will not be accepted.

 

PARKS & RECREATION

CONDITIONS:

1.                   This request does not have an impact to the St. Cloud Parks & Recreation Department.

 

SOUTH FLORIDA WATER MANAGEMENT DISTRICT

CONDITIONS:

1.         This case will require review by the City Engineering Department only.

OSCEOLA COUNTY PUBLIC SAFETY (911 ADDRESSING)

CONDITIONS:

1.                   Applicant shall clear all proposed street names with the 911 Addressing Department prior to a final.  Please submit a site plan for street name review.

 

Mr. Jalovecky noted that he would make the submittal but they would not approve anything until the final plat was approved.

 

Mr. Nearing noted that Mr. Jalovecky needed to get the addresses to Ms. Hobbs as soon as they were available.

 

Mr. Jalovecky asked if he could make changes to the mylar that was submitted with the application and resubmit it for recording and Ms. Hobbs returned the mylar to him before he left the meeting.

 

The entrance gate for the golf course was briefly discussed.

 

FINDING:

The DRC recommended approval with conditions.  The applicant will resubmit the mylar for recording once corrections have been made and the plat has been approved by the Planning Board and City Council.

2.         Case #3-123.01 – Dairy Queen (Parking Lot Only)

                                                Site Plan

 

Mr. Val Taylor, of Hanson, Walter and Associates, was present to represent the application.

 

BUILDING DEPARTMENT

INFORMATION:

1.         This case has no effect on the building department.

 

PUBLIC WORKS

CONDITIONS:

1.         Please provide the stormwater management plan for the additional paved surface entering the site.  The City of St. Cloud Land Development Code allows for a maximum side slope of 2:1 for stormwater management systems. 

 

Mr. Taylor asked if Mr. Luthie had received the information.

 

Mr. Luthie noted that he had.

 

Mr. Taylor noted that he had some concerns regarding the proposed use of the retaining wall.

 

Mr. Luthie explained that the use the retaining walls as proposed would not be allowed.  He noted that he would look at the report and meet with Mr. Taylor later.

 

Mr. Taylor explained that there was no rush because the project was currently in limbo and might even be dead because the project was becoming increasingly cost prohibitive.

 

LINES DIVISION

CONDITIONS:

1.         The water and sewer service laterals will be required to be abandoned.

 

FIRE DEPARTMENT

INFORMATION:

1.         Approval of this case will not cause an adverse affect on fire rescue department operations.

 

OUC (ELECTRIC UTILITY)

CONDITIONS:

1.         The existing poles will remain.

2.         The electric service will be moved as part of the City of St. Cloud Demolition Permit.

 

PLANNING

CONDITIONS:

1.                   Need a variance for the minimum drive width and parking stall depth in the new parking area.

2.                   If the current parking is being re-striped to create the new driveway they should be striped to meet code i.e. 10’ by 20’.

3.                   A small barrier or curb should be used to delineate the parking from the new one-way drive aisle.

4.                   There is a set of plans in the building department that depicts outside seating and the repositioning of handicapped parking. It would be advisable to compare this site plan with the proposed additions to ensure that the two agree or risk having to do a separate site plan to address these minor changes.

RECOMMENDATIONS:

5.         Recommend the plan be approved with conditions meet. The closing of the Georgia exit, which was not to code, is a fair trade-off for the variance requested.

PARKS & RECREATION

CONDITIONS:

1.                   The proposed Laurel Oaks (Quercus laurifolia) will not be accepted within the interior median, Southeast corner and/or along the North buffer.

·         The Oak does not have enough greenspace for maturity if planted within the interior median. Please select another type of median size tree that will be structurally friendly to surrounding concrete/asphalt.

·         Existing overhead utility lines exists along the North buffer (connecting to the adjacent restaurant) and along the East. Please select another type of small size tree that will be utility friendly.

2.                   The proposed “One Way” signage (closest to Louisiana Avenue) seems to be located within the spot of a proposed tree. Please adjust the sign accordingly or shift the tree over allowing visual clearance.

3.                   The original site shall be brought up to Landscaping Standards. This site once held a large amount of vegetation/trees and/or buffer screening. To keep this from going to Code Enforcement, please add required buffer plantings to the original section in accordance with Article VIII, Landscaping. The revised site plan can be reviewed as part of this process.

 

Mr. Taylor noted that he did not have the authority to address the issues of existing landscape because it was not included in the scope of his contract with the owner.

 

Mr. Nearing noted that it was merely a warning to the owner and asked that Mr. Taylor pass the information on to him.

 

SOUTH FLORIDA WATER MANAGEMENT DISTRICT

CONDITIONS:

1.         This project will require review by the City Engineering Department only.

 

FINDING:

The DRC recommended approval of the site plan with conditions.  The applicant will submit corrected plans within 60 day for sign-off.

3.         Case #3-120.01 – Friar’s Cove

                                                Water/Sewer Request (County)

 

Mr. Jim Askey and Mr. Rob Joynes were present to represent the application.

 

BUILDING DEPARTMENT

INFORMATION:

1.         This case has no effect on the building department.

 

PUBLIC WORKS

INFORMATION:

1.         No comment.

 

LINES DIVISION

CONDITIONS:

1.         Water, sewer and reclaimed water are available.

 

FIRE DEPARTMENT

INFORMATION:

1.         Since this project is not in the city limits, it will not receive fire rescue services from the St. Cloud Fire Rescue Department.  Therefore, approval of this case will not have a significant affect on fire rescue department operations.

 

OUC (ELECTRIC UTILITY)

INFORMATION:

1.         No comment.

 

PARKS & RECREATION

CONDITIONS:

1.         This request should not have an impact to the St. Cloud Parks & Recreation Department, at this time.

 

SOUTH FLORIDA WATER MANAGEMENT DISTRICT

CONDITIONS:

1.         This case will require review by the City Engineering Department only.

 

Mr. Askey asked if this project would be required to install reclaimed water lines and Mr. Swingle noted that it would be.

 

Reservation fees for the project were briefly discussed.

 

Mr. Askey asked if the property were to be annexed before construction began if the fees would be less.

 

Mr. Nearing explained how it worked and noted that the applicant would pay the fees that were in place at the time the Certificate of Capacity was issued.

 

Mr. Askey noted that the only problem he saw was that the subdivision already had approval through Osceola County.  He asked if the City would accept the plans as approved by the County.

 

Mr. Nearing noted that the City would accept the plans as approved by the County.

 

Mr. Groenendaal addressed the issue of the property being contiguous and the possible creation of an enclave.  He noted that he would research it and let Mr. Askey know.

 

Mr. Askey noted that annexing the property first was something the applicant was considering.

 

FINDING:

The DRC recommended approval of water and sewer request.

4.         Case #3-120.02 – Friar’s Cove

                                                Friar’s Cove Road

                                                Water/Sewer Construction Plans

 

Mr. Jim Askey and Mr. Rob Joynes were present to represent the application.

 

BUILDING DEPARTMENT

INFORMATION:

1.         This case has no effect on the building department.

 

PUBLIC WORKS

INFORMATION:

1.         No comment.

 

LINES DIVISION

CONDITIONS:

1.                   Identify the lift station using the assigned number 78 and start the manholes with 78-01 through 78-45, starting with number 78-01 closest to the lift station.

2.                   Change the note on the lift station plan on sheet no. 7. The existing wye was installed vertically and will be required to be rolled over, remove the wet tap and show two 45 degree bends, a 6” plug into the wye and the abandonment of the existing 3” FM to include removal.

3.                   Closed impellers are not approved on the lift station pumps. Change to show open impellers.

4.                   Change the elevation between the lead and lag pumps to a 1’ elevation on sheet no.35 and re-submit the lift station calculations package to show this change.

 

Mr. Askey noted that he would make the necessary corrections.

 

5.                   Limit the amount of sanitary sewer services in to the manhole structures to a maximum of (2) two services per structure.

6.                   Indicate the type of crossing and show a detailed profile of the water main crossings on Friar’s Cove Rd. at STA 52+65 and 62+ 43.

7.                   Change the casing size from 2” to a 4” sch 40 on the water main crossing by lot no.’s 27 & 32.

8.                   Provide an air release valve on all high points of the water main.

9.                   Indicate a fire hydrant at the intersection of proposed roadway and Friar’s Cove Rd. by lot no. 63 at STA 4+50.

10.               Extend the water main to the end of construction at the north side of lot no. 62.

11.               Show all temporary blow offs to include 20 feet of pipe between the valve and the blow off assembly.

12.               Provide looping of the 8” water main between lot numbers 23 & 24.

13.               Include the latest version of the City of St. Cloud Standard Details.

14.                A 12” reclaimed water main is currently under design to be extended to the intersection of Canoe Creek Rd. and Friar’s Cove Rd. The main will be required to be extended to this development and provided to all of the lots. Include reclaimed water services to the plans.

 

Mr. Askey asked if re-use credits would be available for the installation of the reuse line down Friar’s Cove Road.

 

Mr. Nearing noted that he wasn’t sure about the line located along Friar’s Cove Road but everything inside the subdivision would be eligible.

 

Mr. Askey asked if the re-use credits were given as each phase was completed or if it was done at the completion of the entire subdivision.

 

Mr. Nearing explained how the credits were issued at the end of each phase.

 

Mr. Askey asked if he had to install the 12” line even if an 8” was sufficient to serve the development.

 

Mr. Swingle noted that the way it usually worked was an 8” would be required and if a 12” was needed, the City would pay for the upgrade in the line size.

FIRE DEPARTMENT

INFORMATION:

OUC (ELECTRIC UTILITY)

CONDITIONS:

1.         Phases 1 & 2 are in the Progress Energy Area. (f/k/a Florida Power Corp.).

2.         Phase 3 is in the Orlando Utilities Commission Area.  OUC will need to have an area set aside the north side of The Main Road to Phase-3 for the electric power.  Any questions please contact LeMoyne Adams, manager of OUC Electric Engineering at (407) 384-4117.

3.         Phase 3 the owner will install all the primary and secondary conduit, primary electric pull boxes, concrete transformer pads and the secondary pull boxes.

4.         A 10 foot wide utility easement will be required on all property lines abutting a right-of-way.  Other easements may be required.

5.         OUC can provide street lighting for this project.  Please contact Development services.
