NEW BUSINESS:

 

1. Case # 11-85.01 - Gramercy Farms

    West of Old Hickory Tree Road and north of Packard Avenue

    Review of Subdivision Construction Plans

 

Applicant and agents: John Eveland, Glen Marvin, and Turner Wallis.

 

The DRC went over the conditions, recommendations and information and indicated to the applicant/agent that the case would move forward when plans meeting the conditions in staff review were submitted. Please review the following DRC comments.

 

PLANNING DEPARTMENT

The Land Development Code (LDC) outlines the standards for Planned Unit Developments (PUD) in Section 3.11.12. The applicant must submit a zoning request, Preliminary Master Plan and a Final Master Plan identifying the agreements between the applicant and the City. 

 

On November 10, 2005, City Council approved Ordinance 2005-142 which established a PUD for the development known as Gramercy Farms.  As outlined in the ordinance Gramercy Farms is permitted to be phased, "amending the phasing plan will only require DRC approval as long as changes are made to the lots and no units are added."  The applicant has requested a phasing change and has also submitted a time line as shown below.  The first phase of Gramercy Farms will consist of 66 single family dwelling units.

 

The Planning Department is moving forward to the Development Review Committee (DRC) with no objections to the new phasing plan for Gramercy Farms.

 

Please review the attached DRC comments.  If all conditions are met then the case can proceed through the approval process. 

 

PARKS & RECREATION

1. Sheet L100, Detail A and B do not meet the required buffering in accordance with the Land Development Code, Article VIII, Section 8.7.2 and Section 8.7.3.

2. Phase 5 includes the CDD Tract (entrance). Landscaping is not shown, nor described. Will the entrance have signage?

3. Will the CDD Park become developed during Phase 5?

4. The CDD Tract, located to the NE of Phase 6, should be re-evaluated.

5. Will the project have Streetscape along the main roadway, up to Phase 1?

6. Please show a typical and/or note(s) describing a tree protection zone in accordance with the LDC, Article VIII, Section 8.3.2.

INFORMATION:

1. The dominate use of Florida native vegetation is greatly appreciated.

 

SCHOOL DISTRICT OF OSCEOLA COUNTY

RECOMMENDATIONS:

  • Additional right-of-way on the west end of this development is required. This will allow for the construction of a turn lane on the road that will run along the north side of the future school site located on LaSalle Avenue.

               

The School Capacity Report contained herein is provided as a planning tool for use by the public and reflects the capacity of the schools affected with the most current FTE enrollment and COFTE projections.  Capacity is available District wide for all grade levels.  A determination of capacity will be required for concurrency and is official only upon the submission of an Application for Capacity Determination and the receipt of a Capacity Response Letter issued by School District of Osceola County, FL.

PUBLIC WORKS

CONDITIONS:

1. Please update the Local Utility Providers table on the cover page.

2. Please provide a copy of the plans for the improvements to Old Hickory Tree Road

3. Please provide a detail of the proposed roundabout.

4. On sheet 4, there is no Phase 2.  Please call out a Phase 2

5. Sheet 9 shows structures over/around sidewalks.  Please provide a detail of these structures.  Please note: no structure can be located within the right-of-way.

6. Please show how offsite drainage is being addressed.  Please see section 6.17.20 of the Land Development Code.

7. Please note: soil cement is no longer an approved base material.  The roadway base must comply with section 6.3.1 (B) of the Land Development Code.  Please note: this section includes separation requirement between the base and the groundwater.

8. Please provide a copy of the geotechnical report and the stormwater calculations.

9. Please provide speed limit signs for the side streets.  These roads should be 25 MPH.

10. Please revise the speed limit sign for the roundabout.  It should be not be signed faster than the speed limit on the collector roadway.

11. Please provide dead end markers for all roadways at the intersections not being extended with Phase 1 construction.

12. Please review the intersection striping detail on sheet 25.  Please adjust the striping to match this detail.

INFORMATION:

13. The existing stormwater pipes must be cleaned and inspected prior to the city accepting the infrastructure.        

14. A plat must be executed for the proposed lots.

 

CONCURRENCY MANAGEMENT

INFORMATION:

1. Water, sewer and transportation impact fees will be assessed at the rate in effect at the time of building permit issuance.

2. Water and sewer impact fee credits will be issued in accordance with the Developer's Agreement approved by the City Council through adoption of Resolution #2006-266 or as amended  and approved by the City Council.

3. Water and sewer impact fees are based upon the potable water meter size installed to provide service to the residential units. Effective January 1, 2012, the ERU rate for one ¾" potable water meter (1 ERU) will be $2,558.84 for water and $2,885.48 for sewer.

4. Based on an automatic ratchet due to take effect on January 1, 2012, transportation impact fee will be adjusted to reflect an assessment of 85% of the net fee of $8,814.00 on January 1, 2012 or $7,492.00 per residential unit.  Transportation impact fees will be assessed at the time of building permit for each unit within the development.

5. The following reservation fees have been estimated for this project and must be submitted prior to a Certificate of Capacity moving forward for City Council consideration:

Water Reservation = $500.00 per ERU (¾" potable water meter)

Sewer Reservation = $$1,000 per ERU (3/4" potable water meter)

6. The balance of the water and/or sewer impact fees, along with applicable tap fees, must be submitted

prior to issuance of water and/or sewer taps for the project.

7. Please be advised that the Certificate of Capacity will not be moved forward to City Council for approval until such time as the applicant pays all applicable reservation fees and notifies the Planner that it is ready.  Your planner will place the item on the next available City Council agenda.

8. All impact fees are subject to change and will be adjusted based upon that which is approved as final by the DRC and those impact fee rates in place at the time of permitting.

LINES DIVISION

CONDITIONS:

1. Any line size changes from original drawings will need new hydraulics calculations provided.

2. Ensure all separations are being met for the water, sewer, reclaim and storm water.

3. Utilize and number all manholes on the drawing from the previous approved plans.

4. All areas that will be irrigated will need a reclaim water service to provide service, size accordingly and

    add to plans.

5. Call out all proposed fire Hydrant assemblies on the proposed water utilities.

6. The proposed 24" reclaim and the 12" water on Gramarcy Boulevard, show the R.O.W / easement lines to ensure no additional easements will be required.

7. Add 2 stub out locations and loop the water and reclaim for Brook dale lane on sheet 36.

8. Sheet 37- sanitary is on bold with clouds from station 65+00, it shown not to be currently installed.

    This may be encountered in other areas, address as needed.

9. Sheet 37- call out line size changes and proper material for reducing, and add water main size east on

    Greenhouse lane

10. Clarify Tee size for the reclaim on Orchid Grove Lane.

11. All off site work will need to be completed,

12. Show sewer services on sheet 48

13. Add valves at proposed Tee locations for optimum isolation with minimal disturbance.

RECOMMENDATIONS:

1. Test and TV all installed sanitary sewer mains and account for all sewer service lines, add as needed.

2. Any material on site from previous excavation will need to be inspected for quality and assurance prior

    to accepting. Any damaged material will not be used in the construction of the utility.

3. Test all gate valves currently installed to ensure working properly

4. The off site plan, with addition of New Nolte road additional tie in points have been installed. This may

    need to be looked at for connections.

INFORMATION:

1. All force mains that are currently installed are under pressure, use caution when making connections.

    Consult with the assigned inspector to assist in isolating the valves. Have all need equipment prepared   

    when making connection to the force main by the lift station. These lines are currently under pressure

    with sanitary effluent.

 

FIRE DEPARTMENT

CONDITIONS:

1. Submit a master plan for fire hydrants showing water mains for each phase or the entire project. The plans submitted are different from the original approved plans and difficult to establish correct locations and distances with submitted plans.

2. Show access to Packard Avenue for public use as the original approval shows.

 

OUC (ELECTRIC UTILITY)

INFORMATION:

1.  The owner will supply, install all the primary and secondary conduit, the concrete transformer pads,

     secondary junction boxes, and manholes. Commercial applications such as sewer lift stations,

      townhouses etc. the owner will install the secondary wire and conduit from the transformer to the

     meter, along with the wire connections and terminations within the transformer.

2. A 10? foot wide utility easement is required on all property lines abutting a right-of-way. Other

    easements may be required for switchgear sites. 

3. There will be costs for temp power to this site.

4. There will be costs to provide electric service to this project, please contact Development Services.

Additional modifications may be necessary after review of the final plat is completed by the City Surveyor. Upon receipt of any required items and confirming that all requirements for the processing of a Final Plat have been met; the case may be scheduled for the next available Planning Commission meeting.

The proposed Site Plan for a convenience store with gasoline pumps has been reviewed by staff.  The following items must be addressed to provide a complete review.  

 

1. Please remove the address from the cover sheet.  An address will be issued by Osceola County 911 Addressing after the proposed site plan has been approved.  The address on the cover sheet is for the adjacent car dealership.

2. Parking requirements on the cover sheet should indicate the outdoor area of 7,540 square feet with eight (8) required spaces per LDC Section 3.18.3.B (1).  A total of 36 parking spaces are required based on the information provided. 

3. Bicycle parking required should indicate two parking spaces instead of three.  The amount of bicycle parking provided is not indicated on the cover sheet or on the proposed site plan.  Please show amount provided and the location of bicycle parking on sheet C6.

4. On the cover sheet the lot coverage indicates a total of 76,223.5 SF.  This amount is incorrect; please revise to indicate correct square footage.

5. The information provided in Site Data, item one on sheet one of the survey is incorrect.  Please revise items to reflect the correct zoning district, setbacks and parking spaces required.

6. The following information addresses Sheet C6
a.       The Trash Containment area refers to Osceola County Section 14.46, please change to reflect City of St. Cloud regulations.
b.      The proposed pole sign refers to Osceola County Land Development Code, please change to reflect City of St. Cloud regulations.
c.       On the proposed building, "1.75 AC" are noted, please indicate what this acreage pertains to as the entire site is 1.96 acres and the building site is only 5,559 square feet.
d.      As indicated in Item 3 of this report, bicycle parking needs to be shown.
e.       On the north property line please site Resolution No. 2011-157R and the approval date of 10-13-2011 for the site variance on the landscape buffer.  Please also note the above information on sheet C-21 of Landscaping Plans.   

7. Landscaping will also be addressed through the City Arborist Kimberly Duffy.

2. It appears that the ?new right-of-way line? is mislabeled on several pages.  Please revise.

3. The northeast sidewalk does not extend to the property line.  Please extend it the entire length of the

     property.

4. The outfall for your pond will be constructed on the adjacent property.  Please provide a drainage easement or a written agreement with the adjacent property owner allowing this construction.

5. Please show how the offsite drainage is being addressed.

6. Please provide a bike rack.

7. On page C12, there are two different pond stage charts. They have different stages.  Please revise.

RECOMMENDATIONS:

1. The Lumen values stop at the north property line.  Please show how your proposed lighting will impact the property to the north.

INFORMATION:

1. It appears that the spot shot at the northeast corner of the gas canopy will not allow for proper drainage.  Please revise (if necessary).

2. All offsite work (piping, roadway alignment, etc.) must be completed and accepted prior to Certificate of Occupancy being issued for this site.        

3. The additional impervious surface will affect the Stormwater Utility assessment for the site.

           

CONCURRENCY MANAGEMENT

1. The submitted Concurrency Management application is incomplete.  A completed application must be submitted prior to final approval.

2. The submitted plans indicate installation of a 2" service meter to the site.  Based on that information the estimated water and sewer impact fees will be as follows:

            Water Impact = $13, 638.62 (based on fees taking effect 01/01/12)

            Sewer Impact = $15,379.61 (based on fees taking effect 01/01/12)

3. Prior to the Certificate of Capacity moving forward for City Council approval the following reservation fees must be paid.  The reservation fees will be credited to the project at the time of final impact fee payment.

            Water Reservation Fee = $2,665.00

            Sewer Reservation Fee = $5,330.00

The Certificate of Capacity will not be moved forward until the reservation fees are paid and you notify your planner that you wish for it be processed.

4. The balance of the water and sewer reservation fees and tap fees are due prior to installation of the services.

5. This use is classified as "retail". Transportation Impact fees have been calculated based on $11,761.00 (fees taking effect 01/01/12) per 1,000 sq. ft. for  5,571 square feet of structure or $65,508.77.  The Transportation Impact fee is due prior to issuance of a Certificate of Occupancy.

CONDITIONS:

1. A minimum 15 foot (15') wide utility easement is required centered over the water main, fire hydrants and up to the water meters.

2. All necessary paperwork for dedication to the City of required Utility Easements must be received prior to release of water meters for the property.  Required documentation for all Utility Easements includes at a minimum suitable easement document, legal description and sketch of the easement, and a Certificate of Title for the parent parcel dated no more than 15 days prior to receipt of the easement paperwork.

3. Show the jumper and all water sample point locations.

4.  All subdivisions, whether inside or outside the municipal boundaries of the City of St. Cloud, must submit a copy of the recorded plat to the Environmental Utilities Department for verification of easement and/or right-of-way dedication and location prior to requesting installations of water and/or sewer taps.

5. Any required changes from Osceola County that may alter these plans will require an additional review by the City of St. Cloud and may require revisions to the plans submitted.

6. Cover Sheet- Change the Phone number for the water and sewer division to

 407-957-7344. Note the additional contact numbers that are on the cover sheet may need to be looked at.

7. Sheet C-13, change note 2 from TWA details to the city of St. Cloud details

8. No Temporary Jumper will be needed for the fire hydrant being installed at station 52+80. Show existing water main incase footage may change.

9. The sewer lateral from main to edge of ROW, change that to 6" and add a cleanout.

10. Fill abandoned water main with a grout material.

11. Add backflow preventers to the domestic and irrigation meters

12. Re- number sample points to correspond with the changes, sample point 3 will not be needed. A sample point is not needed on the domestic service line coming from the meter.

13. Raise or lower existing valve cans and manholes as needed and per the standard detail.

 

FIRE DEPARTMENT

1. The present utilities plans shows one hydrant. The required fire flow on this project is 1500GPM.

     There is an existing hydrant to the north which would meet the requirements. Please submit a letter

     stating this hydrant will remain or if relocated submit plans.

1.  The owner will install all the primary conduit and the concrete transformer pad. The secondary conduit wire, and terminations is the responsibility of the owner. Please have the conduit installed and inspected by OUC three weeks before you need pre-power.

3. There will be costs for temp.  power to this site.

5. Case # 11-55.10 - Public Notice and Advertising Requirements

    LDC - Land Development Code Amendment

The DRC went over the conditions, recommendations and information and indicated to staff that the case would move forward. Please review the following DRC comments.

 

This administrative application requests an amendment to the St. Cloud Land Development Code (LDC) as it relates to advertising and notice requirements for hearings before the Board of Adjustment, Planning Commission, and City Council.  The provisions of the LDC subject to the proposed amendment are in Section 3.4.4, "Required legal notices for public hearing before the Board of Adjustment and Planning Commission? and Section 3.4.5, "City Council, Action on receipt of Planning Commission report."

 

Presently, the LDC delineates the requirements for advertising and public notices.  Upon further research of these requirements, it has been found by staff that there are several conflicting and inconsistent ordinances pertaining to this matter.  The intent of this amendment is to provide clarification and to accommodate for changes as they occur in Florida Statutes as it relates to public notice requirements.

 

The proposed amendment also indicates that any additional legal notice procedures will be maintained in the Planning & Zoning Department as authorized from time to time by resolution of the city council.  These additional procedures proposed for adoption by resolution are as follows:

 

·         A copy of any public notice must be sent to the applicant and/or agent of the respective case via certified mail.

·         All items except Land Development Code amendments, Comprehensive Plan text amendments and Board of Adjustment administrative reviews shall include property posting and notice letter sent via certified mail to property owners (and tenants if the property owner's address is not the same as the physical address) within 300 feet of subject property at least 15 days prior to date of public hearing.

·         In addition to all other applicable requirements, Board of Adjustment variance requests shall be noticed in a newspaper of general circulation in the municipality at least 10 days prior to the date of public hearing.
