I.          Mayor Borders called the meeting to order at 6:30 p.m.

·         Proclamation in recognition of Nurses Week

Mayor Borders presented Inna Makievsky, Carole Pennington, Victoria Feaster, Kim Exantus, Nancy Laliberte and Kimberly Crosson with a proclamation in recognition of Nurses Week.

 

·         Proclamation in recognition of National Public Works Week

Mayor Borders presented Veronica Miller and Scott Adams with a proclamation in recognition of National Public Works Week.

 

·         Proclamation in recognition of Water Reuse Week

Mayor Borders presented Chris Fasnacht with a proclamation in recognition of Water Reuse Week.

 

·         Proclamation in recognition of National Water Safety Month

Mayor Borders presented Beth Walters and Jack Whittaker with a proclamation in recognition of National Water Safety Month.

 

VI.       First Citizen?s Forum - Any person who desires to comment on any item not on this agenda is provided this opportunity to address the City Council. Each person is requested to complete a sign-in form to be provided to the City Clerk prior to addressing the Council.

VII.     Public Hearings          

 

1.      SECOND AND FINAL PUBLIC HEARING FOR ORDINANCE NO. 2012-18, an ordinance of the City Council of the City of St. Cloud, Florida, prescribing the manner of holding the regular election to be held on the first Tuesday after the first Monday of November each election year, to wit: November 6, 2012 with a run-off election on December 4, 2012 (if required), pursuant to Article VIII, Section 8.01 and 8.04 of the charter laws of the City of St. Cloud, providing for an effective date. (Above is full title) ACTION ON ORDINANCE NO. 2012-18

 

City Clerk, Linda Jaworski read Ordinance No. 2012-18 into the record by title.

 

Mayor Borders announced the second and final public hearing for Ordinance No. 2012-18 with no response from the audience.

 

Council Member Griffin made a motion to adopt Ordinance No. 2012-18.  Deputy Mayor Holmes seconded the motion and all members voted aye.  (Vote 5-0)

 

2.      SECOND AND FINAL PUBLIC HEARING FOR ORDINANCE NO. 2012-20, an ordinance of the City Council of the City of St. Cloud, Florida, amending the St. Cloud City Code, Chapter 24, ?Environment?, creating article VIII, ?Pond Maintenance?, providing for proper pond maintenance, specifying terms and procedures for said maintenance, providing for maintenance enforcement and providing that users subject to the penalty provision of the chapter shall have a right of appeal to the code enforcement board related to the alleged violations; providing for codification, severability, repeal of all ordinances in conflict herewith; and providing for an effective date. (Above is full title) ACTION ON ORDINANCE NO. 2012-20

 

City Clerk, Linda Jaworski read Ordinance No. 2012-20 into the record by title.

 

Kevin Felblinger, Public Services Engineering Manager, reviewed the proposed ordinance.

 

Mayor Borders announced the second and final public hearing for Ordinance No. 2012-20 with no response from the audience.

 

Council Member Hopper made a motion to adopt Ordinance No. 2012-20.  Council Member Shroyer seconded the motion and all members voted aye.  (Vote 5-0)

 

3.      FIRST PUBLIC HEARING FOR ORDINANCE NO. 2012-22, an ordinance of the City Council of the City of St. Cloud, Florida, amending the City Code of the City of St. Cloud, Chapter 40, Taxation Article IV, amending verbiage in accordance with Florida Statute 205; amending Section 40-163, schedule of local business tax fees, in accordance with Florida Statute 205; and amending verbiage to local business tax in lieu of occupational license tax and providing for severability, conflict, codification, and an effective date.  (Above is full title) ACTION ON ORDINANCE NO. 2012-22

 

City Clerk, Linda Jaworski read Ordinance No. 2012-22 into the record by title.

 

Robert Wood, Building Official, reviewed the proposed ordinance.

 

Mayor Borders announced the first public hearing for Ordinance No. 2012-22 with no response from the audience.

 

Council Member Hopper made a motion to approve the first public hearing of Ordinance No. 2012-22.  Deputy Mayor Holmes seconded the motion and all members voted aye.  (Vote 5-0)

 

VIII.    Consent Agenda

 

Council Member Griffin asked if items G & H were the same resolutions reviewed a couple weeks back.

 

Mr. Felblinger explained that the resolutions at the last council meeting gave them the right to negotiate with architects while these are the actual contracts for Council to approve.

B.     Resolution No. 2012-053R, a resolution of the City Council of the City of St. Cloud, Florida, authorizing the City Manager to enter into a contract on behalf of the City of St. Cloud, Florida, with the Osceola County Supervisor of Elections, for the purpose of conducting the 2012 Municipal Election.

COST: $10,000.00

 

C.     Resolution No. 2012-054R, a resolution of the City Council of the City of St. Cloud, Florida, prescribing the date of the election, the run-off election (if necessary), the offices to be voted for, the nomination period for candidates, and the precinct locations.

COST: No cost associated with this item.

 

D.    Resolution No. 2012-059R, a resolution of the City Council of The City of St. Cloud, Florida, authorizing the Mayor to enter into an agreement on behalf of the City of St. Cloud, between the City and Dagan P Dalton, M.D., who shall be designated and act as the Medical Director for the City of St. Cloud.

COST: $12,000.00

 

E.     Resolution No. 2012-065R, a resolution of the City Council of the City of St. Cloud, Florida, authorizing the Mayor to enter into a task authorization to the continuing contract and agreement for professional engineering services with Osceola Engineering, Inc. dated July 9, 2009, and any amendments thereto, for Phase 1 and 2 of proposed City of St. Cloud ? Toho Water Authority Reclaimed Water Main Interconnector, and providing an effective date.
COST: $283,470.00 / CONTINGENCY: $14,173.50

 

F.      Resolution No. 2012-071R, a resolution of the City Council of the City of St. Cloud, Florida, authorizing submission of an application to the Edward Byrne Memorial Justice Assistant Grant (JAG) program from the U.S. Department of Justice, Office of Justice Programs (OJP), Bureau of Justice Assistance (BJA) in the amount of $10,846.00, on its conditions.

COST: $10,846.00 

 

G.    Resolution No. 2012-072R, a resolution of the City Council of the City of St. Cloud, Florida, authorizing and directing the Mayor to enter into an agreement with Bumpus and Associates, Inc. per RFQ No. 2012-023 for continuing professional architectural services, on an as needed basis for the City of St. Cloud for work on various City projects, as negotiated by the City Manager on behalf of the City of St. Cloud in accordance with the Consultants? Competitive Negotiations Act and as directed by City Council.

COST: No cost associated with this item.

             

H.    Resolution No. 2012-073R, a resolution of the City Council of the City of St. Cloud, Florida authorizing and directing the Mayor to enter into an agreement with C.T. Hsu & Associates, P.A. per RFQ No. 2012-023 for continuing professional architectural services, on an as needed basis for the City of St. Cloud for work on various City projects, as negotiated by the City Manager on behalf of the City of St. Cloud in accordance with the Consultants? Competitive Negotiations Act and as directed by City Council.

COST: No cost associated with this item.

 

Deputy Mayor Holmes made a motion to approve the consent agenda as presented.  Council Member Griffin seconded the motion and all members voted aye.  (Vote 5-0)

 

IX.       Council Action

 

  1. There are no Council Action items at this time.

 

 

X.        City Attorney

 

City Attorney Oyewale stated she had nothing at this time.

 

 

XI.      City Manager

 

City Manager Hurt stated the May 17th Workshop would include two topics:  Economic Development and property at Stevens Plantation. 

 

City Manager Hurt said he would be out of the office May 28th ? June 2nd to attend the Annual Florida City Manager?s Conference in Bonita Springs.  Veronica Miller, Interim Public Services Administrator, would be in charge during his absence.

 

 

XII.     Mayor and Council Members

 

Mayor Borders stated the Law Enforcement Memorial at the Lakefront would be held on Tuesday, May 15th at 10:00 a.m.

 

Deputy Mayor Holmes asked if the City could implement a Citizen?s Reward Program to recognize citizens and/or businesses either on a monthly or quarterly basis that have gone above and beyond.

           

City Manager Hurt said the process has already begun to create this program.

 

Deputy Mayor Holmes said he had a great time at the St. Cloud High School Hall of Fame induction.

 

Deputy Mayor Holmes recently helped the Education Foundation give out 13 scholarships and said the kids were so thankful for the help.

 

           

Council Member Griffin asked if there had been any progress with commercial recycling.

 

Chris Fasnacht, Deputy Director of Public Service Operations, explained they were testing commercial recycling with Soldier City Saloon and he would report back on the status.

 

Council Member Griffin thanked Council Member Hopper for an enjoyable evening at Smokin? Blues, Bikes & Barbeque.

 

Council Member Shroyer said the Blue Light Ceremony would be held on May 13th, 8:30 p.m., @ the St. Cloud Police Department.

 

Council Member Hopper thanked everyone for coming out to Smokin? Blues, Bikes & Barbeque, and said it was a lot of fun.

 

Mayor Borders said the Law Enforcement ceremony will be at the lakefront this Tuesday at 10:00 a.m.

Connor Rowe stated he was from  Boy Scout Troop 192 and was in attendance to earn his Citizenship in the Community Badge.
