DEVELOPMENT REVIEW COMMITTEE MINUTES

1. Case # 12-25.04 - Nova Park

    Utility easement located east of Underwood Avenue, between Arrapahoe Street and Jack Brack

    Road along the eastern boundary of Lots 31 and 36

    Abandonment of Easement

CONDITION:

1. Staff has received objections from the Development Review Committee regarding the proposed utility

    easement vacation. The agent is encouraged to discuss the submitted conditions and comments with the  

    applicant and the identified utilities to arrive at a resolution prior to moving forward to Planning

    Commission.

 

Mr. Haught acknowledged the conditions and will resubmit revised plans for staff to review. 

 

OUC (ELECTRIC UTILITY)

CONDITIONS:

1. OUC cannot Abandon the Easement at this time, it appears that we have power poles within the easement

    that serves lot 37. A new easement will be required on lot 37 and put in place by the person or company

    that wants to abandon the easement. There will be costs to remove and to replace the existing power line.

Mr. Haught acknowledged the conditions and stated that he e-mailed Mr. Perri in reference to the subject matter. Mr. Haught stated that they would take care of the costs to remove and replace the existing power line to service lot 37. Mr. Haught also noted that he asked Mr. Perri if they could reduce the easement size from 20 feet to 10 feet and Mr. Perri replied yes.

Ms. Giannuzzi informed Mr. Haught that Mr. Perri would have to revise his DRC comments if conditions were satisfied.

1. Bright House Networks(BHN) has reviewed the above referenced request (Case# 12-25.04)

    regarding the abandonment of the 20? wide Utility Easement along the eastern boundary of

    Lots 31 & 36.  BHN has "No Objections" in granting the request as described and illustrated in

    your correspondence dated March 22, 2012.

1. Since this project is not in the city limits, it will not receive fire rescue services from the St.

    Cloud Fire Rescue Department.  Therefore, approval of this case will not have a significant

    affect on fire rescue department operations.

2. Case # 12-30.01 - Villagio

    West of Old Canoe Creek Road approximately a quarter mile northwest of the intersection of Old

    Canoe Creek Road and Canoe Creek Road

    Annexation

INFORMATION:

1. The City of St. Cloud has record that City utility services were granted to the subject properties. Part of the

    agreement for such services was the execution of a "Notice of Encumbrance".  By way of this document

    the action is considered a voluntary annexation.

2. The properties are now able to be annexed as they are adjacent to other properties currently within the

    jurisdiction of the City of St. Cloud.

1. Stormwater Utility and trash pickup fees will be added to your OUC bills once the property is

     annexed into the City of St. Cloud.

 

CONCURRENCY MANAGEMENT

1. The following changes to the subject property will occur after the annexation?s final approval. 

    No action is required of the property owner.  All changes will be handled administratively  

    through the City.

a) Conversion of all water, sewer and reclaim billing (including associated fees such as backflow

    fees) to the City resident rate effective immediately after annexation is completed.

b) Addition of EMS fee effective immediately after annexation is completed.

c) Addition of Stormwater Water fee effective immediately after annexation is completed.

d) Effective October 1, 2012, the addition of Solid Waste fees.  For questions regarding Solid

CONDITIONS:

1. The mail boxes at the following locations need to be move a minimum of 7.5' from the fire

    hydrant.

    a. 2651 Villagio Blvd.

    b. 2650 Dolfino

2. This is a gated community and access for the fire rescue Department needs to conform to City

    of  St. Cloud standards. All gates shall have an access control device approved by the Fire

    Rescue   Department.   (NFPA 1 18.2.2.2) Present approved device is Opti-Com.

INFORMATION:

1. Upon annexation, this site will receive fire protection from the St. Cloud Fire Rescue

    Department.  In order for the site to receive the ISO rating inherent with the rest of the City, a

    hydrant must be located within 1000 feet of any existing structures, measured along the road

    right-of-way and shall not be measured across private property not designated and used as a

    road right-of-way.  Furthermore, any future development will require standards set forth

    according to the City of St. Cloud?s Land Development Code.

    Large Scale Future Land Use

INFORMATION:

1. LDR in the Comprehensive Plan Future Land Use Element allows for a density up to four dwelling units

     per acre.  The subject property has been platted into 109 lots on 28.78 +/- acres which are 3.78 dwelling

    units per acre.  As such, LDR is consistent with the Comprehensive Plan.

2. The proposed LDR Comprehensive Plan Future Land Use Map designation is consistent with the Future

     Land Use from Osceola County.  The table below indicates the Comprehensive Plan Future Land Use Map

    And Zoning designations of the adjacent properties.

    Zoning

 

PLANNING DEPARTMENT

INFORMATION:

1. The proposed zoning for the subject property is consistent with the existing use and is compatible

    with the proposed Comprehensive Plan Future Land Use of Low Density Residential (LDR).

    Additionally, the proposed PUD zoning district is consistent with Osceola County?s PD zoning

    designation. 

2. The subject property has been platted into 109 lots on 28.78 +/- acres which is 3.78 dwelling units

    per acre which is consistent with the proposed LDR.   Given the existing density and the

    applicability of the provision in the Land Development Code, a zoning designation of PUD is

    proposed.
