CONDITIONS:

1.         The roundabout landscaping is called out as Tract L10 on the plat.  However, there’s no mention of the ownership and maintenance by the HOA under General Notes.

 

Mr. Hart explained that Tract L10 had been deleted.

 

2.         General Note #5 makes reference to Tract UB2.  However, the plat shows or identifies the tract as UB2 A.

 

Mr. Hart noted that the plat had been revised to show Tract UB2A

Mr. Hart explained that he was not going to include this in Phase 2.  He noted that he had filed an affidavit of correction to that fact and that the property owner would deed the tract over.

Based on the information from Mr. Hart, this comment was deleted.

 

3.         Tract UB2A should be dedicated to the HOA.

Mr. Hart asked if there would be any way of making the August meeting and Mr. Groenendaal explained that there was not and that it would be going to the Planning Board in August with City Council taking action in September.

 

FINDING:

The DRC recommended approval with the conditions stated.  The case will be moved forward to the Planning Board and City Council for review and action.

 

 

 

 

3.         Case # 4-80.01 – Southside WWTF (Sludge Press)

                                                E of Canoe Creek Road; SE of Golf Course

                                                Site Plan

 

Mr. Todd Swingle was present to represent the application.

INFORMATION:

CONCURRENCY MANAGEMENT

CONDITIONS:

1.                   Since this is an accessory structure a Certificate of Capacity approved by City Council will NOT be required.

2.                   Impact fees shall be at the rate in effect at the time of building permit.

 

After a brief explanation of the project, Ms. Witol noted that the comment would be removed.

 

RECOMMENDATIONS:

3.                   Staff recommends approval with the above conditions.

1.         Upon annexation, this site will receive fire protection from the St. Cloud Fire Rescue Department.  In order for the site to receive the ISO rating inherent with the rest of the City, a hydrant must be located within 1000 feet of any existing structures.  Furthermore, any future development will require standards set forth according to the LDC 7.9.3

2.         An Approved turnaround for fire apparatus shall be provided where an access road is a dead end and is in excess of 150 foot (46m) in length. The turnaround shall have a minimum center line radius of 50 foot

            (15m). The grade, surface and location shall be approved by the authority having jurisdiction. T or Y turnaround arrangements shall be permitted. NFPA1 3-5.2( LDC 6.2.1L)

3.         The entrance shall have a turning radius acceptable for fire apparatus.

 

Fire Marshall submitted the following revised comments during the meeting.

RECOMMENDATIONS:

2.         Provide some type of area for emergency apparatus to turn around.

 

Fire Marshall Ennis explained that if there was an expansion to 14’ it would be OK.

CONDITIONS:

1.         For electric service please contact LeMoyne Adams, Manager of Electrical Engineering at (407) 384-4117.  The site plan has been forwarded to him.

 

POLICE DEPARTMENT

CONDITIONS:

PLANNING

CONDITIONS:

1.         The drive way aisle meets code requirement but should be made wider to 14 feet to accommodate two vehicles needing to pass.

 

Mr. Whitfield noted that he would have no problem with the widening.

 

2.                   The two duplexes are to remain under one ownership. No lot splits will be possible until a subdivision review is completed and improvements are made.

 

Mr. Whitfield noted that he had no objection.

PLANNING

CONDITIONS:

1.                   Applicant to secure a certificate of capacity.  Extension of water and sewer service outside City Limits  and deferral of annexation shall go before the Planning Board on 7/27/04, and the Certificate of Capacity shall be on the 8/12/04 City Council Consent Agenda.

RECOMMENDATIONS:

2.                   Approval with above conditions

INFORMATION:

3.                   This application will also begin the process of annexation of the subject property pursuant to a petition for annexation submitted as a part of this application.  The subject property is not contiguous to the municipal boundaries of the City and therefore, pursuant to State Statute may not be annexed at this time.  Planning recommend deferring any action on the annexation petition until such time as the subject parcel may be annexed in compliance with State Statutes.  This recommendation shall be forwarded to the Planning Board and City Council for their use in review of the petition pursuant to Section 2-256, City Code.

 

FINDING:

The DRC recommended approval of the request for water/sewer to the subject property.  The applicant is to submit a site plan for purposes of Public Works review of the connections only.  No further DRC review will be required.

6.         Case #4-84.01 – Ashton Retail Center

                                                SE Corner of US 192 & CR 15

                                                Annexation/Land Use/Zoning

 

There was no one present to represent the application.

 

Ms. Witol noted that the developers for this project needed to discuss it with the developers for the Walgreen’s site.

CONDITIONS:

1.                   Development of Phase 2 will be allowed under the current County approved site plan as the infrastructure already exists; however, if any additional parking spaces are required the applicant will be required to go through the appropriate mini site plan, minor site plan or full site plan.  According to the site plan submitted 33 parking spaces exist under Phase 1; however, for 7,480 square feet 37 parking spaces are required.

2.                   Phase 3 has a Conditional Use that has expired.  Development of Phase 3 will be required to through the site plan process.

3.                   Please submit drainage agreement or letter from Osceola County regarding the approved Drainage for the site.

RECOMMENDATIONS:

4.                   Recommend approval with the above conditions.  This item shall be on the 8/24 Planning Board agenda and the 9/9/04 and 9/23/04 City Council Agendas.

The DRC continued this case until after the applicant had an opportunity to meet with Walgreen’s.

7.         Case #4-85.01 – Samaniego Project

                                                1604 13th Street

                                                Concept Plan

 

Mr. John Moody and Mr. Paul Forbes were present to represent the application.

 

Traffic circulation at the site was discussed.

 

BUILDING DEPARTMENT

CONDITIONS:

1.         At least one accessible route (special emphasis crosswalk) shall be provided from public transportation stops, public streets or sidewalks to the accessible building entrance per section 11-4.3.2 (1) of the Florida Building Code 2001

 

PUBLIC WORKS

CONDITIONS:

1.         In accordance with Article 6.13.1 minimum dimensions for off street parking stalls.  The minimum travel way width for a 60 degree angled parking is 18’ and for a 45 degree angled parking minimum travel way width is 16’.

2.         The front parking area adjacent to 13th Street is served by a 10.5‘ wide travel way.  Please indicate the method of ingress to the project on 13th Street.

 

CONCURRENCY MANAGEMENT

CONDITIONS

1.         A Certificate of Capacity approved by City Council shall be required prior to receiving a Notice to Proceed.

2.         A Sewer Capacity Reservation Fee in the amount of $284.24 shall be paid prior to receiving a Notice to Proceed.  This amount shall be credited towards the Sanitary Sewer Impact Fee at the time of building permit.

RECOMMENDATIONS:

3.                   Staff recommends approval with the above conditions of approval.

INFORMATION:

4.                    Sewer Capacity Reservation Fee is calculated as 10% of the estimated sanitary sewer impact fee at a rate of $1,100.00 per 1,000 gross square feet of building floor area for Commercial use, per Resolution 98-27R.  In this case:  2,584 sf of building x $1,100 ÷ 1,000 = $2842.40 x 10% = $284.24.

5.                   Impact fees shall be paid at the rate in effect at the time of building permit.  A list of impact fees and rates is available from the Planning & Zoning Department upon request.

CONDITIONS:

1.         The water and sewer services will be required to be upgraded.

 

FIRE DEPARTMENT

INFORMATION:

1.         The initial review of the limited information inherent with a concept plan, nothing appears as if it would cause an adverse affect on fire department operations.  Since items addressing fire protection generally are not shown on concept plans, the fire rescue department will further review the project at the time of site plan submittal.

6.                   Please submit in writing the desired Land Use for the PUD zoning designation for the following property:

PIN 05-26-31-2581-0001-00A0 (Al Bernetti) PUD.  In order to apply for PUD zoning the applicant must submit a preliminary Master Plan ($1,500.00 fee + $10 per acre) and a Final Master Plan ($1,000.00 fee + $10 per acre) will be required within twelve months from the date of preliminary Master Plan approval.  The applicant will be responsible for the costs of certified return receipt mailings to all property owners being affected.

A variance will be required to obtain the PUD zoning designation due to the subject property being less than 20 acres.  The variance must be obtained prior to the approval of the Land Use from the state.  If this is not obtained the property will be zoned to Highway Business.  The cost of this variance is

7.                   A Certificate of Capacity approved by City Council shall be required prior to receiving City water and sewer service.

8.                   A concurrency application for City water and sewer service capacity availability shall be required for any development of the subject property.

9.                   Do any wetlands exist on the subject properties?

10.               DRC Case #’s 04-78.01 and 04-78.02 must be annexed into the city limits prior to this annexation.

Mr. Searl noted that he would be submitting revised documents and would provide surveys as a visual.

 

Mr. Nearing advised Mr. Searl that Osceola County has challenged previous annexations and that he wanted to make sure the applicant understood that there was a potential for problems with the project.  He also noted that he needed to make sure this was something the City could defend in court if the need arose.  Mr. Nearing also noted that he had discussed the project with the Police and Fire Departments and they had no negative comments.

 

Fire Marshall Ennis noted that this annexation could possibly affect the City’s ISO rating and Mr. Searl noted that his clients were open to the possibility of offering land for a fire station.

 

Fire Marshall Ennis noted that this property would be at least five (5) miles from the nearest station and the issue was discussed further.

 

INFORMATION:

12.               Annexation does not form any enclaves.

13.               A list of current impact fees can be obtained from the Department of Planning and Zoning.

 

Mr. Hagen noted that the target was to have everything in to the staff by August 2nd.  A time line for the processing was discussed.

 

The issue of the annexation and it’s affect on the County as well as County reaction to the project were discussed at length.

 

FINDING:

The DRC recommended approval with the conditions as stated.
