DEVELOPMENT REVIEW COMMITTEE MINUTES

 

DATE OF MEETING:      April 20, 2006

 

LOCATION:                   1300 9th Street - 1st Floor – DRC Conference Room; St. Cloud

 

CALL TO ORDER:         2:00 P.M.

NEW BUSINESS:

 

1.                   Case # 04-59.13 – Anthem Park, Ph. 2 (John Groenendaal, Planner)

West of Kissimmee Park Road, South of Neptune Road

                                                            Final Plat; 46.42 Acres, 64 lots, 5 tracts

 

Turner Wallis of Johnston Surveying was present to represent the application.

 

Cyber Spot was discussed.

 

BUILDING DEPARTMENT

INFORMATION:

1.         No comments on this final plat.

 

INFORMATION TECHNOLOGY DEPARTMENT

CONDITIONS:

1.         With the new tract for Smart City Solutions of this replat, fees will be charged on the new tract only. Fees will be based on the square footage of the new tract.

 

PUBLIC WORKS

CONDITIONS:

1.         We could not find reference to right-of-way regarding the Capital Boulevard.  All other streets on the plat seem to have an associated right-of-way width assigned to each street.     

 

Mr. Wallis wanted to know if they could explain.

 

Mr. Luthie noted that they could not find it and if he would simply designate the right-of-way and all others indicate them as public right-of-way.

 

LINES DIVISION

CONDITIONS:

1.         No comments.

 

FIRE DEPARTMENT

INFORMATION:

1.         Approval of this case will not cause an adverse affect on fire rescue department operations.

 

OUC (ELECTRIC UTILITY)

INFORMATION:

1.         The Final Plat meets the requirements of The Orlando Utilities Commission Electric Engineering Division.

 

PLANNING

CONDITIONS:

1.         The revised plat shall include the tract of the Smart City’s trailer.

2.         Tract D was previously processed as Phase 2 with this plat you will need to rename it.

 

There was discussion and Mr. Groenendaal indicated that there was a fear over the confusion.

 

Mr. Wallis noted that they will be condo and that Tract D will not be a new plat.

 

RECOMMENDATIONS:

1.         Recommend approval

INFORMATION:

1.                   The City Surveyor had no issues with the replat of 1A being prepare as presented.

2.                   Revised plans must be submitted within sixty (60) days of this review.  Revised plans submitted after the allotted time frame will require a new application including payment of additional fees. Please be advised that the number of plans required for submittal has increased to 15 sets.

3.                   Applicant shall confer with Osceola County regarding access, right-of-way permits and concurrency prior to Final Site Plan approval for any development application that impacts a County Road.

3.         Please be advised that no model homes or centers will be permitted prior to recording of the final plat.  Any such structures shall also require approval of a “Mini Site Plan”.

 

SOUTH FLORIDA WATER MANAGEMENT DISTRICT

RECOMMENDATIONS:

1.         The District recommends approval.

 

FINDING:

DRC recommended approval with conditions.

 

2.         Case # 06-37.03 – Mallard Pond (John Groenendaal, Planner)

John Kidd was present to represent the application.

INFORMATION:

1.         No comments on this amendment.

CONDITIONS:

1.         No comments on this case.

INFORMATION:

1.         Approval of this case will not cause an adverse affect on fire rescue department operations.

INFORMATION:

1.         No Comment.

 

PLANNING

CONDITIONS:

1.                   There are 2 pods that don’t fall into a phase line. In revised plan bring them into a phase or create a 5     and 6 phase.

 

Mr. Kidd noted that they have revised and corrected

 

INFORMATION:

1.         This project will not go to Planning Board until all DRC items are addressed. Submit one full set corrected and once the plan is approved, 15 reduced full set will be due for Planning Board and City Council.

Mr. Nearing noted that they need to add the condition so that phasing can be modified by staff.

 

Mr. Groenendaal indicated that they will also need a full set of plans so that they can go through concurrently.

 

FINDING:

DRC recommended approval with conditions.

 

3.                   Case #06-69.01 – 4th Street (Jeff Higgins, Planner)

Block 390, between Montana and Columbia Avenues

Abandon Right-of-Way

 

Donna Bowman and Alan Wilson were present to represent the application.

 

BUILDING DEPARTMENT

INFORMATION:

1.         No comments on this abandonment.

 

INFORMATION TECHNOLOGY DEPARTMENT

CONDITIONS:

1.         No comments on this case.

 

PUBLIC WORKS

CONDITIONS:

1.         We will need verification from utility providers that no utilities exist.

 

LINES DIVISION

CONDITIONS:

1.         The Lines Division does not object to this request for abandonment.

           

FIRE DEPARTMENT

INFORMATION:

1.         Approval of this case will not cause an adverse affect on fire rescue department operations.

 

OUC (ELECTRIC UTILITY)

INFORMATION:

1.         OUC has an existing power line that comes from the Montana Avenue side and only an Unobstructed Utility Easement will be accepted.

 

Mr. Higgins noted that they would like to have an unobstructed easement down the center line.

 

Mr. Nearing wanted to know how wide.

 

Mr. Higgins indicated that they didn’t know yet but that they would find out.

 

Ms. Brown noted that they were on the Montana side and that they need both sides.

 

Mr. Higgins indicated that he would find out.

 

There was discussion on the easement.

 

PLANNING

RECOMMENDATIONS:

1.         Approval for 4th St. R-O-W abandonment between Columbia and Montana Ave.

INFORMATION:

1.         Letters were sent to the utilities April 10, 2006.

 

SOUTH FLORIDA WATER MANAGEMENT DISTRICT

CONDITIONS:

1.         This project will require review by the City Engineering Department only.

 

FINDING:

DRC recommended approval with conditions.

 

4.         Case # 06-70.01 – Block 407 (John Groenendaal, Planner)

                                                            Block 407, between New York and Pennsylvania Avenues

                                                            LDC Amendment

 

No one was present to represent the application.

 

Mr. Groenendaal indicated that they still need a payment agreement.

 

BUILDING DEPARTMENT

INFORMATION:

1.         No comments on this amendment.

 

INFORMATION TECHNOLOGY DEPARTMENT

CONDITIONS:

1.         No comments on this case.

CONDITIONS:

1.         We will need a utility easement to maintain service if the alley is abandoned.

OUC (ELECTRIC UTILITY)

INFORMATION:

1.         The Amendment is OK with the OUC Electric Engineering Division.

 

PLANNING

CONDITIONS:

1.         Still need a payment agreement form, we will not advertise for the public hearing until that is prepared.  We could give you an estimate so you are aware of the obligation of signing the document.

2.         We will be recommending approval of the request as we believe the setback of Section 3.20.2.B.6 does not grant a right to the public to traverse private property. This does not prohibit a judge from finding that prescriptive rights exist to do so. 

INFORMATION:

1.         The alley way does appear to have been used on a very limited basis

 

SOUTH FLORIDA WATER MANAGEMENT DISTRICT

CONDITIONS:

1.         The District has no comment regarding this project.

5.         Case # 06-71.01 – St. Cloud Medical Center (John Groenendaal, Planner)

                                                            17th Street, Northeast corner of 17th Street, West of Budinger Avenue                                                          Rezone (Professional) and LUA; 3.59 Acres, 2 lots

 

Jim Potter and Charles J. Bailey were present to represent the application.

 

BUILDING DEPARTMENT

INFORMATION:

1.         No comments on this rezoning.

 

INFORMATION TECHNOLOGY DEPARTMENT

INFORMATION:

1.   With the implementation of the Cyber Spot wireless system thru out the City of St. Cloud, “Cyber Spot Capital Expansion” charges will apply prior to development of said property.

 This fee shall be assessed as follows:

Per Residential Unit: $118.46

Per square foot of Commercial property: $0.0068

Please reference Resolution #2005-418R, Ordinance #2005-168, and Section 6.1.10.1 of the Land Development Code.

1.         The change of FLU from MDR to Professional is appropriate for this part of the City to serve as the   hospital with medical office uses.

2.         The change from R-3 to P is appropriate as part of the land use change

3.         Need a letter of authorization from the current property owner

 

Mr. Potted noted that they will provide this by Monday or Tuesday

 

4.         Need a legal description of the property in electronic format.
