DEVELOPMENT REVIEW COMMITTEE MINUTES

 

DATE OF MEETING:      February 27, 2003

NEW BUSINESS:

 

1.         Case #3-16.03 – Indian Lakes, Phase 2

                                                Michigan Avenue, South of Fertic Road

                                                Final Plat for Phase 2

 

Mr. Chic Greg was present to represent the application.

 

Mr. Greg noted that he had read the comments and conditions and required no discussion.

 

BUILDING DEPARTMENT

INFORMATION:

1.         This case has no effect on the building department.

 

PUBLIC WORKS

INFORMATION:

1.         No comment.

 

CONCURRENCY MANAGEMENT

INFORMATION:

1.                   No comment.

 

LINES DIVISION

INFORMATION:

1.         No comments.

 

FIRE DEPARTMENT

INFORMATION:

1.         Approval of this case will not cause an adverse affect on fire rescue department operations.

 

OUC (ELECTRIC UTILITY)

CONDITIONS:

1.         The Final Plat meets the requirements of the Orlando Utilities Commission Electric Engineering Department for easements.

 

PLANNING

CONDITIONS:

1.                   Please delete the word "Advisory" from the Certificate of Approval by the Planning Board.

2.                   Please include a notation on the face of the plat for the Official Records Book and Page number(s) where the Home Owners Association documents are recorded that cover this portion of Indian Lakes.

RECOMMENDATIONS:

3.                   Staff recommends approval with the above conditions.

INFORMATION:

4.                   Revised plans must be submitted within sixty (60) days of this review.  Revised plans submitted after the allotted time frame will require a new application including payment of additional fees.

5.                   All submitted plans must be folded at the time of submittal.  Rolled plans will not be accepted.

6.                   The Preliminary Subdivision Plan was approved by City Council December 14, 2000, and amended September 13, 2001 and February 13, 2003.

7.                   A Certificate of Capacity was approved for 379 single family detached residential dwellings by Resolution 2000-206R, including this phase.

 

PARKS & RECREATION

CONDITIONS:

1.                   This request should not cause an impact to the St. Cloud Parks & Recreation Department, at this time.

 

SOUTH FLORIDA WATER MANAGEMENT DISTRICT

RECOMMENDATION:

1.         This District recommends approval of this case.

 

OSCEOLA COUNTY PUBLIC SAFETY (911 ADDRESSING)

INFORMATION:

1.         No comment.

 

FINDING:

The DRC recommended approval of the Final Plat with the conditions as indicated.  The case will be moved forward to the Planning Board and City Council for final approval.

2.         Case #2-36.04 – Canoe Creek Plaza

Mr. Todd Hudson was presnet to represent the application.

 

BUILDING DEPARTMENT

INFORMATION:

1.         This case has no effect on the building department.

 

PUBLIC WORKS

CONDITIONS:

1.                   Revise the dedication because Tract “A” and the cross access easements should not be dedicated to the public.

 

Mr. Hudson noted that he would revise the dedication block to reflect “Tract C”.

 

2.                   The utility easements should be dedicated to the public.

 

Mr. Hudson noted that this comment would be taken care of with the change in the dedication block previously discussed.

 

RECOMMENDATIONS:

3.         Why don’t you combine Page 2 of 3, and 3 of 3 into one composite page?

 

Mr. Hudson noted that there were too many overlapping lines and he didn’t think it would be possible but he would look into it.

 

CONCURRENCY MANAGEMENT

INFORMATION:

1.                   A Certificate of Capacity for a 61,483 sf of "Retail, General" and "Food Stores" uses on the subject property was approved by City Council on September 12, 2002 under Resolution 2002-207R.

 

LINES DIVISION

INFORMATION:

1.         No comments.

 

FIRE DEPARTMENT

INFORMATION:

1.         Approval of this case will not cause an adverse affect on fire rescue department operations.

 

OUC (ELECTRIC UTILITY)

CONDITIONS:

1.         OUC Electric Engineering is requesting that the easements for power be shown on the Final Plat.  The overhead line will come from Canoe Creek Road across the south end of tract “C: due to conflicts with trees from the Old Canoe Creek Road side.  I am waiting for an answer from the owner through Jim Wells of RHPA.

 

Mr. Hudson noted that he would work this issue out with Mr. Perri.

 

PLANNING

CONDITIONS:

1.                   Section 5.2.2.5.3 of the Land Development Code requires that a Preliminary Subdivision Plan (PSP) be approved or approved with conditions by City Council with recommendation of the Planning Board and Development Review Committee (DRC) prior to consideration of a Final Plat for approval by DRC, Planning Board and City Council.  No PSP for the subject property has been approved by City Council.  It is suggested that the applicant modify the current application from request for Final Plat approval to

request for Preliminary Subdivision Plan approval.  If done so, the paperwork submitted shall suffice for review as a PSP.

 

Mr. Hudson noted that he understood the comment.  He further noted that he thought he could make all of the revisions necessary to call it a PSP.  He then asked if it would go to the City Council once or twice.

 

Ms. Hobbs noted that advised Mr. Hudson that it would only have to go before the City Council one time.

 

The timing for the remainder of the review process was discussed at length.

 

Mr. Nearing explained that the Exxon project could not proceed without bonding for the public improvements.

 

Mr. Luthie further explained that the applicant had been advised that they could not begin construction on the project without a 110% bonding.  He noted that there had been a similar situation with the Washington Mutual project located in Dylan Plaza.

 

Maintenance responsibilities for the project were briefly discussed.

 

Mr. Luthie requested that Mr. Hudson send him a draft copy of the bond so he could review it for accuracy before it was submitted for acceptance and Mr. Hudson agreed.

 

2.                   Please combine the information on Pages 2 and 3 onto one page.

 

This item was previously discussed and will be deleted at the direction of Mr. Morgan.

 

3.                   Please provide a copy of OR Book 2089, Pages 172-177 as mentioned on the plat face.

 

Mr. Hudson noted that he had emailed a copy to Mr. Morgan.

 

4.                   Please correct the Dedication so that Tracts 'A' and 'B' and Drainage Easements are dedicated to the owners association, Cross Access Easements are dedicated to the lots they abut, and Utility Easements are dedicated to the public.

 

Mr. Hudson noted that this issue had been covered under the deed restrictions.

 

Mr. Morgan noted that it would still need to be shown on the plat.

 

Mr. Hudson noted that it could not be included in the dedication block and Mr. Morgan explained that it could.

 

5.                   Please remove the City Manager title and signature line from the Certificate of Approval by Municipality.

6.                   Please correct General Note # 3 to refer to Tract 'C' as the right-of-way dedication.

 

Mr. Hudson noted that he would delete General Note #3 and put it in dedication block

 

7.                   Please change General Note # 4 to read as follows: "Utility Easements are dedicated to the use of the public."

 

Mr. Hudson noted that the note would be deleted.

 

8.                   Please delete General Note # 5 and change any "OUC Utility Easement" on the face of the plat to "Utility Easement."  This information would be covered under revised General Note # 4.

 

Mr. Hudson noted that the note would be deleted.

 

9.                   Please add a General Note that states that Lots 2 and 4 shall have no direct access to Old Canoe Creek Road.

 

Mr. Hudson noted that the notes would be amended as needed.

10.               Please add a General Note that states that Lots 3 and 4 shall have not direct access to Canoe Creek Road.

11.               Please remove "July _____, 200__" from General Notes # 6 as that date will be determined at the time of recording of the plat.

 

Mr. Hudson noted that he would make the revision.

 

12.               Please provide the entire legal description of the subject property as it appears on the face of the plat in Microsoft Word format via email to "emorgan@stcloud.org" for document preparation purposes.

RECOMMENDATIONS:

13.               Staff recommends denial of a request for Final Plat because a Preliminary Subdivision Plan for this property has not been approved by City Council.

14.               Staff recommends approval with conditions of this submittal as a PSP if the applicant revises the application to request that this submittal be reviewed as a PSP instead of a Final Plat.

 

Mr. Hudson noted that he had discussed this with Mr. Morgan.

 

INFORMATION:

16.               All submitted plans must be folded at the time of submittal.  Rolled plans will not be accepted.

17.               The applicant paid $350.00 for a Final Plat approval review.  The application fee for a PSP review is $750.00 and would be due upon submittal of an amended application.

18.               Construction Plans for a Winn Dixie grocery store on the subject property was approved by DRC on October 10, 2002 under DRC case #2-36.02.

19.               A Certificate of Capacity for a 61,483 sf of "Retail, General" and "Food Stores" uses on the subject property was approved by City Council on September 12, 2002 under Resolution 2002-207R.

20.               The applicant may make submittal for Final Plat approval once the Planning Board has rendered an opinion on the Preliminary Subdivision Plan.

 

PARKS & RECREATION

CONDITIONS:

1.         This request should not have an impact on the St. Cloud Parks & Recreation Department, at this time.

 

SOUTH FLORIDA WATER MANAGEMENT DISTRICT

RECOMMENDATION:

1.         This District recommends approval of this case.

 

OSCEOLA COUNTY PUBLIC SAFETY (911 ADDRESSING)

CONDITIONS:

1.                   Please submit a site plan for review and addressing.

 

FINDING:

The DRC recommended approval of this case as a final plat rather than a Preliminary Subdivision Plan.  A separate submittal will be made for review as a PCP.
